These terms and conditions together with your online purchase order form the  agreement between you and us (“the Agreement”).  1.2 These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except  in writing signed by us or our duly authorised representative. These terms and conditions may be varied by us at any time by  posting amended terms and conditions to our website. The terms and conditions which apply to your purchase will be those terms  and conditions applicable at the time of the purchase.  1.3 These terms and conditions relate to your purchases from us through the Site but do not relate to your use of the Site otherwise.  Please see our separate Website Terms of Use for this and please also see our Privacy Policy for information about how we collect  and use your personal data.  2.  Payment and prices  2.1 All payments for goods must be made by either PayPal or by credit or debit card online at our absolute discretion.   2.2 At the time you place an order you must give authority for payment. We may take payment from you at any time between you  placing the order and us dispatching the goods.  2.3 Your order is an offer to buy from us. There will be no contract of any kind between you and us unless and until we actually take  payment from you. At any point up until then, we may decline to supply the goods to you without giving any reason. If we take  payment and subsequently fail to dispatch the goods for any reason we will refund you in full. 2.4 The prices payable for the items that you order are clearly set out on the Site. If, by mistake, we have under-priced an item, we will  not be liable to supply that item to you at the stated price provided that we notify you before we dispatch the item concerned.  2.5 Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure.   2.6 All prices are expressed inclusive of any VAT payable unless otherwise stated. 3.  Availability  If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you except to ensure that  you are not charged for that item.   1.  Delivery  1.1 Delivery will be made by ordinary post to the address specified by you on the completed order form. Please be aware that goods  may not fit through your letter box and you may be required to be in at your address or attend a mail sorting office to receive them.  1.2 Approximate delivery times will be given to you at the time of placing your order. Whilst we make every effort to ensure your goods  are delivered within such approximate timeframes, the goods are delivered through the ordinary post by a third party and we will  not be liable if the goods do not arrive within such timeframes or due to circumstances beyond our control.  2.  Return of goods  2.1 We hope you will be happy with your purchase. However, subject to clause 7, should you feel it necessary to return the goods, you  may cancel the contract for its purchase by contacting us on admin@stateless.uk.com within eight working days of receiving them.  You should then return the relevant item to us in secure packaging to Stateless ltd, Room 107 Lombard business park, 8 Lombard  Rd, London SW19 3TZ  2.2 If you cancel the contract for your purchase you will be responsible for retaining the goods and ensuring that they remain in the  same condition they were in when you received them until you send them back to us.  2.3 You will be responsible for the cost of returning any item to us unless the item is defective or we have delivered the item to you in  error. The item should be returned to us in its original condition. If we do not receive the item back from you we may arrange for  collection of the item from you at your cost.  2.4 When we receive notice of cancellation of your contract for any item, we will refund the price paid by you for that item or at your  request if the item is defective will repair the item or supply you with a replacement item. We will not refund the delivery charge for  sending the item to you unless you are returning an entire order. If we pay for the return of or to recover the goods in any way we  reserve the right to charge you for such costs incurred by us. 3.  Cancellation and changes prior to delivery  Subject to clause 7, you can cancel or change any of your current orders prior to dispatch by contacting us on admin@stateless.uk.com.  Bespoke goods 0.1 Clauses 5 and 6 will not apply to any bespoke goods you have ordered which have been created at your request, incorporate a  design you have provided us with or which are altered or produced so as to be different to any other goods available to other  customers to order on the Site.   0.2 You may not cancel or change an order for bespoke goods prior to delivery and you will not be entitled to a refund even if you return  the bespoke goods to us after they have been delivered to you. You will be liable for payment of the price for the bespoke goods  from the moment you order them and any refund for bespoke goods will be at our absolute discretion.  1.  Our Liability  1.1 Subject as expressly provided in these conditions, and where you are not dealing as a consumer (within the meaning of the Unfair  Contract Terms Act 1977), all warranties conditions or other terms implied by statute or common law are excluded to the fullest  extent permitted by law. 1.2 Where items are sold under a consumer transaction your statutory rights are not affected by any of these terms and conditions.  1.3 Any claim by you which is based on any defect in the quality of the goods supplied or their failure to correspond with specification  must be notified to us as soon as possible from the date of delivery or (where the defect or failure was not apparent on  reasonable inspection) within a reasonable time after discovery of the defect or failure. If you do not notify us accordingly, you will  not be entitled to reject the goods and we shall have no liability for such defect or failure.  1.4 Where any valid claim in respect of any of the items supplied which is based on any defect in the quality or condition or their failure  to meet specification is notified to us in accordance with these conditions, we shall be entitled to replace or repair the items free of  charge or at our sole discretion, refund to you the price of the items (or a proportionate part of the price), but we shall have no  further liability to you.   1.5 We shall not be liable to you by reason of any representation, or any implied warranty, condition or other term or  any duty at common law, or under the express terms of these terms or this Agreement, for any consequential loss  or damage (whether for lost profit, lost opportunity or lost reputation or otherwise), costs expenses or other claims for consequential compensation whatsoever (and whether caused by our negligence, our employees or agents or  otherwise) which arise out of or in connection with the supply of goods or their use or resale by you, except as  expressly provided in these conditions. 1.6 Our entire liability under or in connection with these terms and conditions shall not exceed the price of the items  supplied. 1.7 Nothing in the this clause 8 or any other of these terms and conditions will exclude or limit our liability in respect of death or personal  injury caused by our negligence  2.  Applicable Law  These terms and conditions and this Agreement will be subject to the laws of England and Wales. We will try to solve any disagreements  quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must  do so within the United Kingdom.  1.  Miscellaneous 1.1 You may not transfer any of your rights under these terms and conditions to any other person.
